Set out below are the Terms and Conditions of TonerTrain.co.uk. Please read before purchasing from us. TonerTrain.co.uk reserves the right to amend its policy periodically. Please check this page regularly to ensure you are aware of any changes made. This policy is effective from 1st JAN 2012.

1. Definitions of Terms used

  1. ‘Toner Train Limited’ or ‘Tonertrain.co.uk’ or ‘Seller’; we or us
  2. ‘Customer’ or ‘Buyer’ denotes any person or company who intends to purchase or has purchased from TonerTrain.co.uk.
  3. ‘Consumer’ denotes an individual who is not acting for the purposes of a business or profession and whose order, when placed, has no connection with a Company name in any manner.
  4. ‘Business Customer’ denotes someone who represents a business. Such a person is not regarded as a ‘Consumer’.

 

2. Prices

  1. Goods and services provided, together with VAT due (charged at 20%), are invoiced at the price prevailing at the time of placing an order.
  2. TonerTrain.co.uk reserves the right to modify prices periodically.

 

3. Payment

Payment for the goods, delivery charges and VAT (charged at 20%) can be made by any method shown on the TonerTrain.co.uk website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which will enable TonerTrain.co.uk to terminate the contract immediately. There will be no delivery until cleared funds are received, unless agreed (this may not apply to business customers where another method of payment has been agreed).

 

4. Delivery

We will deliver the goods ordered by you to the address provided by you on the order form. Delivery will be made as soon as possible after your order is acknowledged by us and we will endeavour to dispatch any order on the order day of the date of your order. However, if you do not receive goods ordered by you within the agreed time period due to circumstances beyond our control, we will have no liability to you. Please note that it may not be possible for us to deliver to some locations, or within specific timeframes. In such circumstances we will notify you at the first available opportunity. In the case of next working day delivery we cannot and will not be held responsible for any delivery problems associated with the courier. Typically 97% of orders are completed the next working day, and we try our best to maintain this level of service.

You will become the legal owner of the goods you have ordered when payment for the goods has been debited from your account and when they have been delivered to you. The goods will be held at your own risk from delivery. We will not be liable for their loss, damage or destruction after they have been delivered to you. This website is aimed at United Kingdom residents only. If you are resident outside the United Kingdom, the importation or exportation of goods by us to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or

import of the goods you purchase from this website. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from this website.

Short shipments: You are required to notify us within 3 days in writing that items are missing from the consignment.

Short shipments have to be confirmed by the warehouse before replacement items can be issued. The dispatching warehouse will either undertake a stock level count and/or provide proof on hand of weight measures controls that are done prior to shipping in the warehouse and at second stage when couriers receive consignments. The results of the two independent weight checks have normally the same values with a possible slight variation. NOTE: if outer box was damaged and it was not mentioned by the customer in writing on the consignment documents upon delivery acceptance, no claim can be made either with the courier or TonerTrain.co.uk.

 

Force Majeure

TonerTrain.co.uk Cartridge People shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control. 

 

Title to Goods

On delivery in the case of goods delivered to the buyer or goods delivered directly to another location specified by the buyer and at the time of collection in the case of goods collected from the supplier’s premises. Title and ownership of the goods remains vested with the seller until the seller has received payment in full for all sums due for the goods supplied to the buyer. Until payment of the purchase price the buyer shall store the goods separately to any goods, which belong to the buyer or any third party, and shall be clearly marked and identifiable as the sellers property. If the buyer fails to make any payment to the seller when it falls due, a bankruptcy order is issued against the buyer, the buyer enters into a voluntary arrangement with its creditors, or being a company enters into a voluntary or compulsory liquidation or has an administrator or administrative receiver or receiver appointed over all or part of its assets or suffers any similar action or if the seller has reasonable cause to believe that any of those events is likely to occur, the seller shall have the right without prejudice to any other remedies:

  1. To withhold delivery of any undelivered goods and stop delivery of any goods in transit;
  2. To require the buyer to part with possession of any goods owned by the seller; and
  3. To enter without prior notice any premises where goods owned by the seller may be located and repossess any goods owned by the seller.

 

Returns Policy

Your rights to return goods are protected under the EU Distance Selling Directive. You are entitled to cancel your order and return the goods within 7 working days for a full refund, including the cost of delivery. Do this by contacting us by email or telephone and quoting the order number supplied to you. Your refund will be paid within 30 days. You are responsible for the cost

and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value. This cancellation policy does not affect your rights when we are at fault - for example, if goods are faulty or misdescribed. Any goods returned should be in fully saleable condition. In some circumstances, a re-stocking fee may apply. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future. None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.

 

General Information

These terms and conditions, together with the current Cartridge People Web site prices, delivery details and Cartridge People contact details, set out the whole of our agreement relating to the supply of the goods to you by Cartridge People. These terms and conditions cannot be varied except in writing signed by a director of Cartridge People. In particular nothing said by any sales person on behalf of Cartridge People should be understood as a variation of these terms and conditions or as an authorised Cartridge People representation about the nature or quality of any goods offered for sale by Cartridge People. Cartridge People shall have no liability for any such representation being untrue or misleading.
